Terms of Service — Oretly
1. Who we are and what Oretly does
Oretly is a mobile application operated by NXTY Sagl, Switzerland (hereinafter "Oretly", "we"). Contact: info@oretly.ch.
Oretly is exclusively a meeting place: it puts people who need a few hours of work done in their home (the "Clients") in touch with people who offer those hours (the "Providers"). Oretly is not an employer, is not an employment agency and is not a party to the contract that Client and Provider conclude between themselves. It does not set the rates, does not direct the work, is not liable for it and does not collect the payment for the services.
2. Who can use the application
Use is reserved for adults with capacity to act. Registration requires a valid e-mail address, verified by means of a one-time code.
On first access the Provider declares that they are authorised to work in Switzerland and that they comply with their legal, tax and insurance obligations (OASI/DI contributions [AHV/IV, AVS/AI], withholding tax where applicable, accident insurance, residence and work permits). The declaration is a condition of use: the substantive verification remains the Provider's responsibility.
3. Relationship between Client and Provider
The service contract arises directly between Client and Provider. It is a matter between them: the subject of the work, the number of hours, the hourly rate, any materials, the place, the schedule, the payment.
Payment for the service takes place outside the application, in the manner the parties agree. Oretly does not receive, does not hold and does not transfer the payment, and does not retain any percentage of it.
Each party is responsible for their own obligations: the Client for the payment and for the safety of the place where the work is carried out, the Provider for the proper performance, for their own insurance and social-security position and for any damage caused during the service.
4. How the service works
- Map and search. Provider profiles appear on a map by area. The position shown is deliberately approximate: it does not correspond to anyone's exact address.
- Board. The Client can publish a request; Providers can apply.
- Chat. Every contact goes through an internal conversation, which follows precise states (contact open, job planned, job completed). The phone number is shown only after both parties have explicitly unlocked it.
- Hours log. Once the job is finished the parties record the actual hours; the system generates a summary in PDF, which serves as a shared reminder and not as an invoice.
- Reviews. After a completed job each party can review the other. One-star reviews are subject to verification before publication. We do not publish reviews that are offensive, defamatory or unrelated to the work carried out.
5. Subscriptions
Basic use of Oretly is free. Optional subscriptions are available that increase visibility and enable the verified badge:
| Plan | Price |
|---|---|
| Provider Basic | 5 CHF per month |
| Provider Premium | 10 CHF per month |
| Client Premium | 10 CHF per month |
Subscriptions are taken out exclusively through the App Store (Apple) or Google Play, which handle payment, renewal and invoicing.
- Renewal is automatic, unless cancelled at least 24 hours before the end of the current period.
- The charge is made to the store account in the 24 hours before the renewal.
- Cancellation and management of the subscription are done in the settings of the user's own App Store or Google Play account, not from Oretly.
- Refunds follow the store's conditions: Oretly can neither grant nor refuse them.
- In the event of non-renewal or a payment problem, the plan becomes suspended and the premium features are deactivated; the account and the data remain.
Launch promotions. The first users to sign up are granted a period of free premium access (90 days for the first 100 sign-ups, 30 days from the 101st to the 500th). It is a time-limited free access granted by Oretly, not a subscription: on expiry nothing is charged and the account returns to the basic plan.
6. Rules of conduct
By using Oretly, users undertake to: provide truthful information; not publish unlawful, offensive, discriminatory or misleading content; not use the application to offer services other than those intended; not collect other users' data; not circumvent the application's features.
Anyone who experiences improper behaviour can report the conversation. The report blocks the chat and makes its content available to the administrators for verification.
7. Suspension and closure of the account
We may suspend or close an account that violates these terms, in a proportionate manner and, where possible, with prior notice. In the event of a serious violation (harassment, fraud, unlawful acts) closure is immediate.
Every user can delete their own account at any time from the application, in the profile section. The effects of deletion are described in the privacy notice.
8. Identity verification (verified badge)
The verified badge is obtained by uploading an identity document, which is encrypted, examined manually and destroyed within 48 hours of the decision. The badge attests that we have seen a document: it is not a guarantee of the quality of the work, nor is it insurance.
9. Liability
Oretly provides a technical platform and is responsible for its own operation with the due care that can be expected. To the extent permitted by law, Oretly is not liable: for the conduct of users; for the performance, quality or payment of the agreed services; for damage caused by one user to another; for the accuracy of the content published by users.
No clause of these terms limits liability for unlawful intent or gross negligence, nor the mandatory rights granted to consumers.
The service is provided "as is". Interruptions may occur for maintenance or technical reasons.
10. Intellectual property
Oretly's name, logo, graphics and software are protected. Users remain the owners of the content they publish and grant Oretly a free licence, limited to what is needed to make the service work (displaying the profile, delivering messages, publishing reviews).
11. Changes
We may change these terms. Significant changes are communicated with reasonable notice, to the registered e-mail address or in the application. Continuing to use Oretly after they come into force counts as acceptance.
12. Applicable law and jurisdiction
Swiss law applies. The competent court is that of the owners' domicile in Switzerland, without prejudice to the mandatory places of jurisdiction provided for consumers.
